How to register land in Azerbaijan?

If you found a perfect land plot and are dreaming of building a cozy house in Azerbaijan for weekends with your loved ones, remember that the first step is to ensure the land is properly registered. Don’t forget that in Azerbaijan, land can be owned by the state, municipalities, or private individuals, according to the Constitution and the Land Code of Azerbaijan.

In this article, I’ll explain how to privatize land that has been allocated by the state or municipality for use or ownership by individuals and legal entities.
Now, let’s delve into the process of land registration in Azerbaijan.
Grounds for land privatization in Azerbaijan
In accordance with Art. 8 of the Law “On the State Register of Real Estate” of the Republic of Azerbaijan, there are the following grounds for registering rights to a land plot:
– Acts adopted by the Executive Authority and municipal bodies on the sale, lease, use and pledge of real estate.
For example: Executive Authority’s decree (order) on the allocation of land or a decision of a municipality on the allocation of land, etc.
– Lease agreements, orders and warrants issued by the gardening departments of the relevant bodies of the Executive Authority for garden plots allocated to citizens, membership books issued according to the list of members of a collective farm gardening partnership, or extracts from the minutes of a meeting of members – briefly “Gardening Acts”.
Documents required for land privatization
To privatize land in Azerbaijan, the following documents must be provided:
1) The relevant decision of the Executive Authority on the allocation of a land plot;
2) The plan and dimensions of the land plot;
3) The decision of the municipality on the allocation of a land plot for the construction of a residential building and the purchase and sale agreement (in accordance with Art. 6.2 of the Law of Azerbaijan “On the Management of Municipal Lands”);
4) The protocol of the auction for land plots sold by the municipality after 01.12.2007, and the purchase and sale agreement concluded as a result of such an auction;
5) Technical passport, plan-drawing of the building, structure, structures and other real estate (if there is any structure on the site);
6) Receipt for payment of the state fee.
Where to apply for land privatization?
After collecting all the documents required for the privatization of a land in Azerbaijan, you must contact the State Real Estate Service.
Thus, in accordance with the Charter of the Service, it has the authority to refuse, suspend production on the submitted documents, and also authorized to issue a corresponding extract from the real estate register (bill of sale), which confirms the fact of registration of property rights.
FAQ
In what period are land rights registered?
If there are no grounds for refusal, the State Service on Property Issues shall register the rights to real estate within 10 working days from the date of filing the application and the package of documents and shall prepare the corresponding extract from the state register in electronic form.
The registration period for rights to real estate may be extended by the registering authority up to 5 working days in connection with the survey and inventory work required to register the property right. In such a case, the Service shall inform the applicant.
