Extension of temporary registration in Azerbaijan

   Arrived to Azerbaijan, passed the temporary registration upon place of stay and received a “TERRIBLE” notice that the date of registration will be valid for the next 90 days (conditionally).
   What does it mean, what to do if the term is about to end and you don’t want to pay a fine (which ranges from 300 to 400 manats)?

   First of all, DO NOT confuse the extension of period of temporary stay and temporary residence permit (TRP) and permanent residence (PRP) in Azerbaijan! I have already described the procedure of getting a TRP in Azerbaijan in relevant article.
   So, what is the procedure for extending the period of temporary stay in Azerbaijan? Let’s review the procedure step by step. So…

Where to apply?

   Extension of period of temporary stay in azerbaijani called MOM.
   The authority responsible for issuing MOM decision is the State Migration Service of Azerbaijan.
   To extend the period of temporary stay, you must contact the Migration Service no later than 3 working days before the expiration of the period of temporary stay in the Republic of Azerbaijan and submit the necessary documents.
   This can also be done by contacting the relevant regional branch of the Migration Service, ASAN service or using online services through the
eservice.migration.gov.az website.

Grounds for extensions of temporary registration in Azerbaijan

   Temporary stay in Azerbaijan can be extended in the following cases:

  • In case of urgent medical treatment in the territory of the Republic of Azerbaijan;
  • In case of serious illness or death of any close relative residing in Azerbaijan;
  • In case there is a justified application on incompleteness of intended works by foreigners and stateless persons arrived in the Republic of Azerbaijan related with official necessity, submitted by the organization inviting those persons;
  • In case of emergency stop during the transit passage of foreigners and stateless persons in the territory of the Republic of Azerbaijan;
  • In case of extension of temporary staying period of father, mother, husband (wife), child, brother, sister of a foreigner or stateless person in the Republic of Azerbaijan.
   Important note: Foreigners who arrived to Azerbaijan on a visa basis can extend the period of temporary stay for a period not exceeding the period specified in the visa, and foreigners who have arrived on a visa-free basis can’t stay in Azerbaijan for more than 90 days.

What documents are required?

    To extend the temporary stay period in Azerbaijan you need to submit the following documents:
   1)
Application form;
   2) Copy of passport;
   3) Notarized copy of birth certificate or other equivalent document (for those who do not have a passport and are under 18 years old);
   4) Document confirming the existence of grounds for extending the period of temporary registration;
   5) 2 photos sized 3,5×4,5 sm;
   6) Document of a residential area where the person shall be registered on (extract on the state registration of the property right from state registry of real estate, rent or tenancy agreement or other similar document);
   7) Application of the owner of the residential area, who provides a foreigner or stateless person with a residential area (except the cases when there is a residential area in possession of the foreigner or stateless person);
   8) Copy of the ID of the person providing the foreigner or stateless person with a residential area;
    9) Receipt certifying payment of the state fee*.
   *
Note: Receipt certifying payment of the state fee shall be presented upon receival of decision of Migration Service on extension of the period of temporary stay in the Republic of Azerbaijan.

According to Article 42.7 of the Migration Code of Azerbaijan, if your application in extension of the period of temporary stay was denied, you will have to leave the country before the end of the period of temporary stay. In the event that the period of your temporary stay ended during the period of submission or consideration of the application for an extension, then you will have to leave Azerbaijan within 48 hours.

No, the extension of period of temporary registration is not a basis for obtaining Azerbaijani citizenship.
